Selling in America - contracts and insurance - advice needed

I am an artist who also makes jewellery. A large American retail company wants to order a quantity of bangles and before they will issue the order i have to sign a Terms of Purchase Agreement. Amongst several ambiguous (and rather frightening) clauses this one stood out:

Vendor agrees to indemnify Company and save it harmless from all liability, claims, suits and actions which may be made or brought against it by virtue of claims or demands of any kind which any purchaser of such merchandise from Company or any other person may make against Company arising from the sale or use of such merchandise or from any defects in the quality of such merchandise or the dangerous conditions thereof, and agrees to pay any judgment against and assume any liability or expense of Company in connection with any such claim. Vendor shall procure and maintain adequate products liability insurance and commercial general liability insurance (including personal and advertising injury) with a contractual liability endorsement covering Vendor's indemnity obligation under this Agreement and shall furnish to Company certificates thereof in connection with each order. Such policies shall name Company as an additional insured thereunder.

My legal advisor has said i should not sign it unless they agree in writing to waive this clause and also a couple of other ones. In addition they want me to get my work certified free of lead, at my own expense. (anyone know anything about how to do this?) They will ship and pay duties etc but there is so much documentation - i even have to get my own labels and barcodes printed out - yet another expense! So i am wondering if there is any point going ahead with it - it is a very prestigious retailer and it would be wonderful to sell to them particularly as they approached me in the first place... so has anyone out there got any experience of this, and if so can you share it with me. Thanks

I seem to feel free to explore the horizon which is clearer than it use to be. I create work because I crave the unknown. Our imaginations are grandeur and free to explore, I feel as artists we have a great opportunity from others to see the world in a different view.
I feel it is, in our hearts to feel guilt and art is a obsession if you are, a true artist at heart, we live, eat and breath the world of art because we were born that way. I could not think my life without art, what would I do? What would be my reason for life? My intentions? I seam to struggle to answer questions without my art. I create art because I need it. I want it and I will always crave it.

Gallery - Monthly Picture Payment Scheme

Hi

Have recently had work exhibited in a group exhibition in a gallery. Fortunately I sold 3 pieces. I have been advised I will receive payment for 2 of them (have not yet received payment) but the third has been sold through the monthly payment scheme so I will not receive payment until the painting has been fully paid for.

Unfortunately, against my better judgement, everything has been done via email and verbally (no terms and conditions etc). Nothing was mentioned either verbally or via email about this scheme in the event of me selling a painting.

Not sure how to proceed. Should I just wait and see if I get paid eventually or ask for something more specific in writing as to when I can expect to be paid for this third piece of work?

Any advice you can give will be greatly appreciated.

Many thanks.

AB

Degree Show-Finding the New Talent

A man crouches in a box of a room, lit from its walls, floor and ceilings lined with one thousand, three hundred and sixty-nine filament light bulbs. He dreams of five phonographs, simultaneously playing Louis Armstrong’s ‘What Did I Do to Feel so Black and Blue’ over and over again, the trumpet reverberating off the walls. The underground vault, secretly siphoning energy off the Monopolated Light and Power Company, is his sanctuary, a hideout maybe, and it is also a cocoon. And in that, where he re-imagines the world and himself to in turn become a source of emancipation and potential. This striking image of a shining underground beacon from the prologue to Ralph Ellison’s novel Invisible Man (1947) came to mind when thinking about this year’s UEL degree show.

Because though it’s virtually impossible to round up in a few words the scope of this gang working across a range of media, one strong element you can find among this set of practices is the unrelenting question of how we - as individuals or communities- relate to our environment. How we navigate, make sense and interact with our surroundings, which then through this questioning becomes how each takes hold and re-casts the world as their own. For some it is entangled with the layers of unknown landscapes, for others it is in constantly hitting up against immutable surfaces; for yet others it is a re-placed nature, and for some a photorealism tweaked ever so slightly with a pointed fantastical element. In my short time helping to teach at UEL, I’ve encountered a refreshing unorthodoxy from the students—see for yourself here the breadth and energy of how these graduates have re-visioned the world.

Chris Fite-Wassilak
Writer and curator

Choose a spot where you get an even light. If the sun is beaming this may be too harsh, creating sharp shadows, if your not positioned in the right place. A slightly cloudy, but bright day will give you a warm light, whereas a dark overcast will give you more blues... cold light. So you should look at your style of work and consider if warm or cold tones work best. A sunny day can work, but there ideally need to be something blocking the rays.

Props can compliments what you do. Your work may look great photographed out doors, next to an object or landscape that really brings your work to life.

Traditional straight forward framed shots (which is what I have used) do a clean job... but I have seen some wicked examples of artwork being photographed in different ways.... of course this has to compliment!

All the best - hope that helps :)

Joyce

Specifically: it is said that you fix under running water - but can a water tray be used (and running water simulated with swishing!) I thought I would take a water butt and a deep tray (like underbed storage) to do the developing bit.

Are there any issues to watch out for?

Cheers!

Re: Photographing artwork/Manchester

Best to choose a grey day, where the light very "samey". Outside. Use the lowest iso setting ie 80 but ensure that your camera will take the photo quick enough not to give you blur. Tripod useful, or rest camera on anything solid to keep it still, however, depending on the light levels you can hand hold the camera.

The better camera you have available the better the quality of the image, it depends on your purposes how important this is. Also save to TIFF or RAW if you have a choice on your camera so you get a digital file with the maximum information on it. If it's just for web or your reference this doesn't matter so much.

If you have different options on your camera for monitoring, ie, spot, multi, or average, take images with each of them and weigh up which you think is best. If you have Photoshop or similar this is handy for adjustments.

Also good to slightly underexpose if possible I find. Only slightly.
Having work vertical, horizontal, at an angle, you just need to experiment with what works best. But a grey, slightly overcast day, is a must.

Re: MA London or not?

Hi

You will definitely not be losing out by not being in London. I have spent the last 13 years in London doing my BA (hons) and post grad in Fine Art. Depending on what your practice is and how old you are London may suit you, but based on the experiences of myself and some my peers its highly competitive and stressful. To put it plainly it ain't all that.

Space is at a premium in London art schools. You will have a studio space no bigger than a small desk and part of a wall. My postgrad had 50 of us crammed into one room.

In order to survive and buy materials you need you will have to work part time. There are some post grad accommodation at some of the institutions but finding a flat can be difficult. Its always best to check out the notice board at the institution to see about rooms, flat shares etc University of the Arts London that houses CSM, Chelsea, Wimbledon, Camberwell etc run an excellent housing service and student services.

I can help you with more specific questions if you want. I take it you will be applying for next year as it seems quite late now.

Re: MA London or not?

Hello, I am currently exploring the possibility of an MA myself. I think the main question you need to be asking yourself is what you want to receive from an MA, then look at what perhaps different institutions have to offer. It is after all a really expensive commitment, so you would want to make sure you are doing what benefits you most. Some important factors to look at might be:

- Proportion of theory/practical work - Different institutions will vary, some may hold most of the importance on theory, research and written reports, while others are more practical and studio based.
- Amount of taught time - If you are more of an independant worker and feel like you would be able to motivate yourself with little support or perhaps if you prefer more guidance, critical analysis and feedback from tutors when you work.
- Some institutions may have scholarships, bursaries or AHRCbursaries, which will offer to pay for all or part of your fees.

Re: Should the 'meaning' in work be obvious?

What an interesting thread.I do agree with the point raised that it depends on the piece of work itself. To me it has posed the question of difference between meaning and concept. Meaning, to me is quite definitive and final, the work means this and this is what it is. I feel perhaps concept allows a looser perspective on this. The artist can project a certain concept upon the work, but ultimately how this is taken on by each individual within the audience is variable. The artist isn't imposing restraints upon the audience, which could possibly alienate them, by implying this is what they should think, feel and take away from the piece.

The Big Society

We are a group of artists who are trying to deliver a broad range of Art of all types to our community. I wondered if anyone could suggest a success story using the Big Society model, working collaboratively with existing scattered groups and a Local Authority. We hope to access funding outside of the Local Authority coffers where possible to minimise the burden to the members of our Community. We are a town which has an abundance of pound, phone and charity shops and large retailers tend to shy away from the demographic of our town. I need to research how other people have managed to deliver arts in this way under similar circumstances (obviously notwithstanding the current downturn). We are based in the East Midlands, our region has been identified as an arts 'Cold Spot'. Could anyone signpost me to a group which I might be able to contact. As a Committee Member I am on a steep learning curve and any help given would be much appreciated. I look forward to hearing any comments you might have on the Forum

KLA charge 60 per month, heating has just been installed and may be charged for at some point in the future. Spaces are, I think, 80 sq.ft. I am moving to a 100 sq.ft space for 60 a month, with heating thrown in but electricity is charged, and vat, and Im not sure about internet access. KLA do have internet access included. Hope this helps.
