Selling in America - contracts and insurance - advice needed (no replies)

I am an artist who also makes jewellery. A large American retail company wants to order a quantity of bangles and before they will issue the order i have to sign a Terms of Purchase Agreement. Amongst several ambiguous (and rather frightening) clauses this one stood out:

Vendor agrees to indemnify Company and save it harmless from all liability, claims, suits and actions which may be made or brought against it by virtue of claims or demands of any kind which any purchaser of such merchandise from Company or any other person may make against Company arising from the sale or use of such merchandise or from any defects in the quality of such merchandise or the dangerous conditions thereof, and agrees to pay any judgment against and assume any liability or expense of Company in connection with any such claim. Vendor shall procure and maintain adequate products liability insurance and commercial general liability insurance (including personal and advertising injury) with a contractual liability endorsement covering Vendor's indemnity obligation under this Agreement and shall furnish to Company certificates thereof in connection with each order. Such policies shall name Company as an additional insured thereunder.

My legal advisor has said i should not sign it unless they agree in writing to waive this clause and also a couple of other ones. In addition they want me to get my work certified free of lead, at my own expense. (anyone know anything about how to do this?) They will ship and pay duties etc but there is so much documentation - i even have to get my own labels and barcodes printed out - yet another expense! So i am wondering if there is any point going ahead with it - it is a very prestigious retailer and it would be wonderful to sell to them particularly as they approached me in the first place... so has anyone out there got any experience of this, and if so can you share it with me. Thanks

Gallery - Monthly Picture Payment Scheme (no replies)

Hi

Have recently had work exhibited in a group exhibition in a gallery. Fortunately I sold 3 pieces. I have been advised I will receive payment for 2 of them (have not yet received payment) but the third has been sold through the monthly payment scheme so I will not receive payment until the painting has been fully paid for.

Unfortunately, against my better judgement, everything has been done via email and verbally (no terms and conditions etc). Nothing was mentioned either verbally or via email about this scheme in the event of me selling a painting.

Not sure how to proceed. Should I just wait and see if I get paid eventually or ask for something more specific in writing as to when I can expect to be paid for this third piece of work?

Any advice you can give will be greatly appreciated.

Many thanks.

AB

Degree Show-Finding the New Talent (1 reply)

A man crouches in a box of a room, lit from its walls, floor and ceilings lined with one thousand, three hundred and sixty-nine filament light bulbs. He dreams of five phonographs, simultaneously playing Louis Armstrong’s ‘What Did I Do to Feel so Black and Blue’ over and over again, the trumpet reverberating off the walls. The underground vault, secretly siphoning energy off the Monopolated Light and Power Company, is his sanctuary, a hideout maybe, and it is also a cocoon. And in that, where he re-imagines the world and himself to in turn become a source of emancipation and potential. This striking image of a shining underground beacon from the prologue to Ralph Ellison’s novel Invisible Man (1947) came to mind when thinking about this year’s UEL degree show.

Because though it’s virtually impossible to round up in a few words the scope of this gang working across a range of media, one strong element you can find among this set of practices is the unrelenting question of how we - as individuals or communities- relate to our environment. How we navigate, make sense and interact with our surroundings, which then through this questioning becomes how each takes hold and re-casts the world as their own. For some it is entangled with the layers of unknown landscapes, for others it is in constantly hitting up against immutable surfaces; for yet others it is a re-placed nature, and for some a photorealism tweaked ever so slightly with a pointed fantastical element. In my short time helping to teach at UEL, I’ve encountered a refreshing unorthodoxy from the students—see for yourself here the breadth and energy of how these graduates have re-visioned the world.

Chris Fite-Wassilak
Writer and curator

Particular problems I can envisage for example are getting all works on a website so that they can be bid on/bought which might require complicated shopping cart services and websites etc. Or should I be looking to find a venue in London? who will give space for works to be pinned up (assuming they are all a standard size on paper and unframed).

I may be over complicating something that should be relatively simple to sort out and initiate, so any thoughts would be helpful.

Thanks
Tracy

We are renting a space for the show, and it seems we would already be insured for such an event through the 'public liability' coverage. We were told that we would need to get bespoke cover, but now I'm not so sure...Has anyone else had such an experience? How can I figure out what is required without contacting the insurance company which will probably attempt to make me pay for coverage I may not need??
Thanks, Georgia

I'm still waiting for the stuff to arrive, but wondered if anyone has had experience of it. Specifically: it is said that you fix under running water - but can a water tray be used (and running water simulated with swishing!) I thought I would take a water butt and a deep tray (like underbed storage) to do the developing bit.

Are there any issues to watch out for?

Cheers!

I wondered if anyone could suggest a success story using the Big Society model, working collaboratively with existing scattered groups and a Local Authority. We hope to access funding outside of the Local Authority coffers where possible to minimise the burden to the members of our Community. We are a town which has an abundance of pound, phone and charity shops and large retailers tend to shy away from the demographic of our town. I need to research how other people have managed to deliver arts in this way under similar circumstances (obviously notwithstanding the current downturn). We are based in the East Midlands, our region has been identified as an arts 'Cold Spot'. Could anyone signpost me to a group which I might be able to contact. As a Committee Member I am on a steep learning curve and any help given would be much appreciated. I look forward to hearing any comments you might have on the Forum

Funding (no replies)

I have just read on AIR, that another Arts Initiative is closing, Lantern House, not surprising really, throughout the last administration (New Labour) many of these ACE funded organisations sprung up as the system was awash with poorly targeted UK and EU funds.

Whilst the intentions may have been good and worthy, they merely created a massive and expensive funding trail, with often high administration and salary costs with their final output usually supported by the unpaid, the Artist.

Today in my mail box, I received a twelve page document from a company, dealing with the liquidation of one such company, which I am apparently a creditor to the tune of £1.63. In the meeting minutes are all the details of the organisations fundings and costs, with two of the three years complete accounts showing significant losses. The outstanding figure is the Director(s) salary, which in actual terms is not as large as say a Bankers, but taken as part of the total budget would actually make Bankers pay and bonus's look comparatively small if the same percentage to turnover was applied.

Any monies or assets left in this organisation will be swallowed up by the cost of liquidation, for example they charge a pound per page, so far I have received around twenty pages in three letters, posted first class and charged at 3x the postal cost, so again money is being made out of the residual monies intended to support the arts by non-artists.

I have always considered that any money available for funding should go direct to the artist, and not through organisations such as those now closing due to lack of funding. This will allow the artist to apply the money to create and exhibit the work, if this means that organisations (Galleries) are commercially set up to facilitate such exhibitions, then that is fine because the artist will control the market for the purpose of promoting art and not some pseudo regional politic or local eco-social requirement actually unrelated to the needs of the artist.

In conclusion I look forward to the day that all these expensive and mainly irrelevant institutions are gone, and what little money that will be available will go direct to the artist and their output will create a new more sustainable art scene.

Is a degree really beneficial? (1 reply)

I am halfway through studying for my degree in BA(Hons) Fine Art Photography. I know that after I graduate next Summer I want to pursue becoming a professional photographer.

At the moment I am using the photographic medium to investigate my passion for running, in particular, using documentary photography.
However I feel as though I am doing something wrong, as my tutor feels it isn't the best form for communicating what it feels like to run and be a runner. Comments have also included that I am not pushing myself by working solely in photography.

I completely disagree. I believe even as a very competent photographer, I have so much that I can learn and that photography is one big learning curve, similar to any other art form.

I feel as though achieving a good grade at the end of my degree is in jeopardy if I continue to work in photography alone.
I just wonder what other peoples opinions are about this?

I have found this amazing place in Glasgow [www.catdigital.co.uk] but they only print per metre.

Does anyone have any recommendations?

I have had some samples done with a company called 'Citrus Rain' that I found online but they were not finished very well. I am looking to sell them as editions so want them to be as well made as possible.

Thanks in advance!

I'm thinking of re training and doing a social work degree hoping that at some point in the future the two can come together...maybe around Art Therapy or working creatively with vulnerable children. Is there anyone working around these two disciplines? Or anyone in social work? I'm only hearing negativity around studying in this area..has anyone got anything positive to say please?

Warning and a question about Nails Gallery, Bristol (1 reply)

For two years I have been trying to get paintings/prints and payment owed from the sale of paintings and prints from the Nails Gallery in Bristol. Each time a different excuse has been given to me by the owner of the gallery, Steve Eades as to why this was not possible. The gallery has recently closed leaving a number of artists without their work or payments. I would just like to warn any artist that has further dealings with him to be very wary and if anyone else is in the same situation I would appreciate you letting me know as we will have a stronger case together.
Additionally if anyone has any advise as to possible action that can be taken it would be nice to hear from you.
Thanks
Emmie

www.emmievb.com
